The grievance of the petitioner is that a miscellaneous appeal preferred by the Opposite Parties has been kept pending since March, 2023. 2.

After perusal of the materials, I find that the majority of the adjournments granted were due to service having not yet returned and as such, the learned District Judge, Paschim Medinipur cannot be blamed for the delay as such.

However, keeping in view the urgency of the petitioner, CO 3026 of 2024 is disposed of with the expectation that the miscellaneous appeal shall be disposed of by the learned District Judge, Paschim Medinipur as expeditiously as the business of the said court permits.

In view of the innocuous nature of the above order, no service of notice on the Opposite Parties is directed.

No order as to costs.

The parties and all concerned shall act on the server copy of this order without insisting upon prior production of any certified copy for the purpose of compliance.
