The petitioner has challenged the final order of assessment made in the name of a deceased person who was the father of the petitioner. According to the petitioner, the allegation against the petitioner was incorrect and erroneous as the petitioner did not have any connection with the meter which was found to be used for theft of electricity.
2. Under such circumstances, no order can be passed in this writ petition, save and except granting leave to the petitioner to pursue his remedy before the appellate forum. As the petitioner had filed the writ petition within time, the question of delay would not arise. The petitioner will approach the appellate authority within a period of 10 days from date. As no affidavits have been called for, the allegations against the petitioner are deemed to be denied.
3. Accordingly, the writ petition is disposed of.
4. All the parties are directed to act on the basis of the server copy of the order.
