Today, the learned advocate representing the petitioner submits on instruction that petitioner does not intend to press this writ petition and at this time it is also submitted that the petitioner wants to file fresh writ petition on the self-same cause of action with better particulars.
Eastern Railways is represented by learned advocate who submits that due to pendency of this writ petition the steps pursuant to the demand laid against the petitioner could not be taken.
Having considered the submission made on behalf of the parties this writ petition is dismissed as not being pressed with liberty to file afresh with better particulars on the self-same cause of action.
However, this order shall not preclude the concerned respondent authorities to take steps in accordance with law.
Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
