According to the petitioners due to the absence and inaction on the part of the Sabhapati of the Jhalda1 Panchayat Samity, the petitioners, being the elected members of the Panchayat Samity are suffering a stalemate.

It has been submitted that no development work can be performed in the said Panchayat Samity area in view of the non-cooperation of the Sabhapati. The petitioners claim to have made a representation before the District Magistrate, Purulia by a letter dated September 16, 2019 which appears to have been received by the office of the District Magistrate on September 20, 2019. It has been alleged that the said representation has not been considered by the respondent till date.

The petitioners pray for consideration of the aforesaid representation.

As it appears that the representation is pending consideration at the end of the respondent for a considerable period of time, the Court thinks it fit to direct the District Magistrate, Purulia being the respondent no. 3 herein to take necessary steps for consideration of the representation made by the petitioners, strictly in accordance with law, within a period of ten weeks from the date of communication of a copy of this order. The District Magistrate shall afford an opportunity of hearing to all the necessary parties and pass a reasoned order and communicate the same to all the parties immediately thereafter.

WPA No. 19118 of 2019 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
