The instant intra court appeal is directed against the order dated 23rd December, 2021 passed by a learned Single Judge of this Court in W.P.A. 11676 of 2020.

30 petitioners, who are over qualified, made a representation to be allowed to participate in the recruitment process published by the West Bengal Board of Primary Education dated 23rd November, 2020. The online application portal was open upto 1st December, 2020. The writ petition was filed on 21st December, 2020 after long closure of the portal. The writ petition came up for admission hearing for the first time in December, 2021. The proceedings before the learned Single Judge of this Court themselves may have become infructuous as on the date of the writ petition being taken up.

In that view of the matter, this Court finds no reason to interfere with the impugned order.

Interim order, if any, is vacated.

5.

M.A.T. 1490 of 2022 shall stand dismissed.

In view of dismissal of the appeal itself, the connected application being CAN 1 of 2023 shall also stand dismissed.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
