WPA 21987 of 2017 With CAN 1/2019 (Old No. CAN 2599/2019) Joydeep Mukhopadhyay Vs.

State of West Bengal & Ors.

Sk. Imtiaj Uddin ...for the Petitioner.

CAN 1/2019 (Old No. CAN 2599/2019) 09-01-2024 AKG Ct. 238 This is an application for restoration. Having regard to the averments made in paragraphs 4, 5 & 6 of the application, I am of the view that the petitioner has sufficiently explained the reason for his nonappearance before this Court on February 14, 2019 when the matter was called for hearing.

Accordingly, CAN 1/2019 (Old No.

CAN 2599/2019) is allowed and the writ petition is restored to its original file and number.

WPA 21987 of 2017 Let the affidavit of service filed by the petitioner be kept with the records.

Respondents are not represented.

It is the grievance of the petitioner that he was appointed as a Lecturer in the Department of Mathematics at St. Paul's Cathedral Mission College by a letter dated October 20, 1997. After serving for about two years, the petitioner took a lien to join Jogesh Chandra Chaudhuri College as a Lecturer in the Department of Mathematics. The petitioner continued his service at Jogesh Chandra

Chaudhuri College. The petitioner, by several representations, requested the Principal of St. Paul's Cathedral Mission College for providing his Service Book, Pay-fixation Memo, Confirmation Letter and last Pay Certificate of his service covering the period from January 5, 1988 to January 31, 2000. The college, regrettably, did not make any response.

In view of the aforesaid grievance of the petitioner, this writ petition is disposed of with a direction upon the Principal, St. Paul's Cathedral Mission College to duly consider the request of the petitioner for return of his Service Book, Payfixation Memo, Confirmation Letter and last Pay Certificate. The Principal is further directed to provide the aforementioned documents to the petitioner within a period of one month from the date of communication of this order, should the petitioner be legally entitled to such documentation. WPA 21987 of 2017 is disposed of.

Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with the requisite formalities.
