Smt Pitali Bera (Nayak) Mr. Subrata Santra ... for the petitioner Mr. Tanoy Chakraborty Mr. Sourav Bera Mr. Chhandak Dutta Ms. Twinkle Santra ... for the opposite party This revisional application is disposed of upon modifying the order dated August 25, 2022, passed by the learned District Judge, Tamluk, Parba Medinipur in Act VIII Case No.20 of 2021, with the following directions:- a) On every second Saturday and Sunday of the month, the father/petitioner will visit the child at the mother's residence between 5 p.m. and 7 p.m. The mother will allow interaction of the child with the father in a separate room. The father is entitled to take the child to a park or any other playing area. The mother may accompany the father and the child during such outing. No other person will be allowed.
b) On the fourth Sunday of every month, the child will be taken by the father to his house at Tamluk. The child will interact with the father and his relatives and shall have lunch
with the family. The child shall be returned at around 4 p.m.
This arrangement shall continue for the time being.
It is made clear that on the days of the child's visits to the father's house, the father shall not take the child outside the house and the mother will be entitled to speak to the child via video conferencing once during such visit. The child should be taken to the father's house by private transport and upon maintaining proper safety and security.
Learned advocates on record for the respective parties in the learned court below, shall coordinate the entire arrangement. It is also made clear that the father has undertaken before this court, that he will bear the admission fees and monthly tuition fees of the child. Upon the mother giving details of the school to which the child will be admitted and the fees to be paid for such admission, the money shall be paid or reimbursed by the father as per the direction of the learned court below. The school should be close to the child's present place of residence.
The revisional application is thus disposed of. All the parties are directed to act on the basis of the server copy of the order.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
