Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner complains that an advance was made to an Event Management Company thereby advancing a sum of Rs.2,50,000/- for organizing a ceremony at the banquet hall of NX Hotel, E.M. Bypass. However, the ceremony was initially fixed in the month of February, 2025, but subsequently the same was held on 25.06.2025. Petitioner complains that he has been duped of sum of Rs.2,50,000/- by the Event Management Company along with others.

Be that as it may, since the police report primarily reflects that there were certain adjustments, the police authorities are of the opinion that prima facie the issue has been resolved. However, the petitioner claims that the Event Management Company has duped the petitioner and insists upon the same.

Having considered the issue canvassed by the petitioner, I am of the view that the petitioner would be at liberty to approach the jurisdictional Magistrate under Section 175(3) of BNSS. Learned Magistrate would assess and ascertain regarding the genuinity of the allegations so far as the transactions are concerned and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations, the writ petition being WPA 20838 of 2025 is disposed of. There will be no order as to costs.
