We have considered the materials on record. Petitioner is the principal accused. He had hit the victim on the head with a hammer. He does not stand on the same footing with co-accused who is on bail.

Under such circumstances and in view of the gravity of offence and the principle role played by the petitioner in the crime, we are not inclined to grant bail to the petitioner. 4.
