2. Affidavits of service filed in Court today are taken on record.

3. Petitioners'

representation seeking removal of encroachment made over the State Highway is pending consideration at the end of the respondent authority for a considerable period of time.

4. Without entering into the merits of the claim of the petitioners, the instant writ petition is disposed of by directing the Executive Engineer, Barasat Highway Division, Public Works (Roads) Directorate, the respondent no. 3 herein to consider and dispose of the legal representation dated 2nd July, 2024 filed on behalf of the petitioners in accordance with law after giving reasonable opportunity of hearing to all the necessary parties and by passing a reasoned order.

5. Steps shall be taken in the matter at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

6. Learned advocate for the petitioners is directed to forward copy of the representation dated 2nd July, 2024 along with all supporting documents to the aforesaid respondent at the time of communicating the order of this Court.

7. The writ petition stands disposed of.

8. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all the requisite formalities.
