On the other hand, learned advocate for the private respondents submits that a civil suit being TS 1810 of has been preferred by the respondent no.5 which is pending before the learned Civil Judge (Jr. Divn.), 1st Court, Alipore wherein an ad interim injunction order has been passed.

also submits that a title suit being TS 542 of 2023 is pending wherein an order of injunction has also been passed.

Be that as it may, the police authorities have already registered a criminal case. As such, the investigating officer is directed to ensure that during pendency of the criminal case, no further incident occurs which would blow out of proportion.

Since, prima facie, it reflects that there are injuries which were inflicted for which the provisions of Sections 115(2)/118(1)/109 of the BNSS have been incorporated, in case, there are further violation, the petitioner would bring it to the knowledge of the learned ACJM, Alipore. The learned Magistrate would pass specific direction so that the petitioner, who has set the law into motion, in any manner, is not subjected to further torture.

With the aforesaid observations,

WPA 20743 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copy of the report be handed over to the petitioner.
