Case No.83 of dated 27.02.2024 under Sections 21(c)/22(c)/23(c)/27A/28/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In the matter of:

Hafijur Rahaman ... petitioner Mr. Kaushik Coudhury ... for the petitioner Ms. Sreyashee Biswas Mr. Parvej Anam ... for the State Learned counsel for the petitioner submits that apart from a statement of a co-accused, there is no other material available against the present petitioner.

Learned counsel for the State strongly opposes the prayer for anticipatory bail, relies on the report which is taken on record and submits that the petitioner has a criminal antecedent and he has been charge-sheeted in that case under provisions of the NDPS Act.

Considering the materials available in the case diary and the fact that the petitioner has criminal antecedent involving provisions of the NDPS Act where he has purportedly been charge-sheeted and in view of the restrictions contained under Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail, is thus, rejected.
