Learned advocate appearing the petitioner submits that the petitioner is in custody for 248 days and the recovery in the present case is of 150 bottles of Phensedyl, although no recovery has been effected from the possession of the present petitioner. It has been submitted that charges are yet to be framed and at least 28 witnesses have been named in the charge sheet.
On the other hand learned advocate for the State opposes the prayer for bail and submits that there are call data records, certain money transactions which are reflecting in evidence and there are antecedents of the present petitioner.
Be that as it may, having considered the period of detention of the present petitioner, I am of the view that as similarly placed accused person has been granted bail in CRM (NDPS) 1383 of 2025 petitioner be extended with the same privilege.
Accordingly, the prayer for bail of the petitioner is allowed.
Petitioner, namely, Papai Das shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge (under NDPS Act) cum ADJ, 3rd Court, Balurghat, Dakshin Dinajpur. If on bail, petitioner shall be physically present on each and every date fixed by the learned Trial Court and shall not leave the jurisdiction of District of Dakshin Dinajpur without the prior permission of the learned Trial Court. Accordingly, CRM (NDPS) 1108 of 2025 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
