Raghunath Bera v. State Of West Bengal
C.R.M. (A) 4419 of 2022 15.09.2022 Sl.14 Court No.29 (AD) (Rejected) In Re: - An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Pursurah Police Station Case No.110 of 2022 dated 15/07/2022 under Sections 420/506(2)/120B of the Indian Penal Code. And In the matter of: Raghunath Bera ....petitioner.
Mr. Ujjal Ray ...for the petitioner.
Mr. Tanmay Kumar Ghosh, Ld. Sr. Government Advocate Mr. Arindam Sen Ms. Pritha Paul ...for the State.
Petitioner prays for anticipatory bail.
Learned Advocate appearing for the petitioner submits that the petitioner is the mechanic attending to vehicles. The petitioner introduced the purchaser of the vehicle to the broker. Apparently, according to him, there are disputes between the original owner of the vehicle and the new purchaser. The petitioner was falsely implicated.
Learned Advocate appearing for the State draws the attention of the Court to the materials in the case diary and in particular to the statement of the witness recorded under Section 161 of the Code of Criminal Procedure.
There are materials in the case diary suggesting that the petitioner is involved in a racket of passing off vehicles to unsuspecting purchasers for valuable consideration and not making over documents with regard to such vehicles.
The materials in the case diary suggest a requirement of
custodial interrogation of the petitioner.
In such circumstances, we are unable to grant anticipatory bail to the petitioner.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
C.R.M. (A) 4419 of 2022 is dismissed.
