Mr. Sudip Ghosh Chowdhury Ms. Shreyata Mitra Ms. Afrin Nahan Mondal ..for the petitioner Mr. Saibal Acharyya Mr. Tanweer Jamil Mandal ..for DPSC, Purba Burdwan Affidavit of service filed in Court is taken on record. The petitioner is aggrieved by the Office Memorandum of the Chairman, District Primary School Council, Purba Bardhaman being memo no. 2911/1(90) dated 22nd July, 2024.
By the said memorandum the Council adjusted the teachers of different circles on temporary basis in the interest of primary education and the teachers were directed to join their respective new places of posting within seven days.
The petitioner who was working in the Galsi, Purbapara Free Primary School has been proposed to be transferred to Bahirghannya F.P. School in the circle of Galsi.
Learned advocate for the petitioner submits that the petitioner is agreeable to join the transferred place of posting but the communication to the transferee school is very difficult.
A representation has been filed by the petitioner which is pending consideration. Though the learned advocate for the petitioner asserts that copy of the representation was duly served in the office of the Chairman, District Primary School Council, Purba Bardhaman but there is no proof of service of the said representation before the authority.
In view of the above, the instant writ petition is disposed of by granting leave to the petitioner to file appropriate application highlighting her prayer before the concerned authority. In the event such representation is made, the same shall be considered in accordance with law at the earliest but positively within a period of six weeks from the date of communication of this order. A reasoned order shall be passed and communicated to the petitioner immediately thereafter.
The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
