On the undertaking of learned advocate for the respondents to file another copy of the affidavit filed in Court today, which is described as "Affidavit-inOpposition", CPAN 1407 of 2024 is taken up for hearing.

We find from the aforesaid affidavit that the Assistant Engineer (in-charge), Building Department, Howrah Municipal Corporation, has passed an order dated April 01, 2024 after hearing the parties. This was precisely the direction in our order dated February 07, 2024, violation whereof is alleged in this contempt application.

In view of such order having been passed by the Assistant Engineer (in-charge), Building Department, Howrah Municipal Corporation, our order stands complied with. The contempt proceedings stand closed. CPAN 1407 of 2024 is disposed of.

If the petitioner is aggrieved by the order passed by the Assistant Engineer (in-charge), Building Department, Howrah Municipal Corporation, he shall

be at liberty to challenge such order in accordance with law before the appropriate forum.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court.

6.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties on compliance of all necessary formalities.
