In view thereof, this matter is taken up on the request made by Mr. Zaman.

This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), 2nd Court at Baruipur to dispose of Title Suit No. 366 expeditiously.

Learned advocate appearing for the petitioner submits that August 6, 2024 was fixed for filing of the written statement and written objection by the defendants.

From the order-sheets appended to this application more particularly, the order dated April 8, 2025 this court finds that August 6, 2025 was fixed

for filing written statement and written objection by the defendant nos. 1, 4 to 6 only. It further appears that August 6, 2025 was fixed for service return on the rest of the defendants. There are as many as 15 defendants in the said suit.

Unless and until all the defendants have been served, no direction for expeditious hearing of the suit can be passed at this stage.

With the above observations CO 3262 of 2025 stands disposed of.
