This revisional application under Article 227 of the Constitution of India has been filed with a prayer for expeditious disposal of the Title Execution No.23338 of 2014 pending before the learned 4th Civil Judge (Senior Division) at Alipore.

Learned counsel appearing on behalf of the petitioner submits that the learned Trial Court was already directed twice by this Court in CO 1695 of 2016 on 20th July, 2016 and in CO 617 of 2018 on 13th September, for expeditious disposal of the Execution Case No.23338 of 2014 along with Misc. Case No.240 of 2016. It is further submitted that Misc. Case No.240 of 2016 has already been disposed of by the learned Trial Court but Execution Case is still pending. 3.

Considering the nature of the prayer, I do not find any reason to ask the petitioner to serve notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

Accordingly, the learned Civil Judge (Senior Division), 4th Court, Alipore is requested to dispose of the Execution Case No.23338 of 2014 within 12 weeks from the date of communication of this order. 5.

With the aforesaid observation, the revisional application, being CO 2946 of 2023, stands disposed of. 6.

Learned counsel appearing on behalf of the petitioner is at liberty to communicate this order to the notice of the learned Civil Judge (Senior Division), 4th Court, Alipore, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
