1. Heard learned lawyers for both the parties.

2. The petitioner is in custody for four years. He prays for bail. He contends his identification in court is unreliable as the witness deposed the petitioner was shown to him at the police station.

Learned Advocate for the State opposes the bail prayer. 4.

We have considered the materials on record. The petitioner is alleged to have murdered and robbed the victim. Offences, if proved, would attract mandatory life imprisonment. PW 1 identified the petitioner during trial. It is trite identification in court is substantive evidence and its impact is to be assessed in the backdrop of other relevant materials on record. 5.

In view of the aforesaid incriminating evidence and gravity of offence, we are not inclined to enlarge the petitioner on bail. 6.

CRM (DB) 2776 of 2024 is, thus, dismissed.
