Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of informing the Officer-in-Charge, Sagardighi Police Station on or about 14.07.2025 no steps have been taken. Learned advocate draws the attention to the contents of the information furnished with the said police station wherein it was alleged that when the petitioner along with his brothers had been to their land/property the private respondent with deadly weapons threatened the petitioner of dire consequences including murdering them.

Learned advocate for the State has submitted a report. Report reflects that on receipt of such information, police authorities have drawn up

proceedings under section 126 of the BNSS. On the other hand, learned advocate for the private respondent submits that a title suit being TS No. 131/21 is pending before the learned Civil Judge (Junior Division) Additional Court, Jangipur. Be that as it may, prima facie the civil court is in seisin of the land dispute. So far as the police authorities are concerned, police authorities have already drawn up proceedings under section 126 BNSS. They would continue their surveillance and would ensure that there is no violation of law and order.

With the aforesaid observations WPA 20750 of 2025 is disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
