Mr. Ranjan Kali .....For the Petitioner Mr. Susovan Sengupta Mr. Tarak Karan .....For the State The allegation of the petitioner is that no steps have been taken by the police authorities pursuant to the complaint lodged by the petitioner vide letter dated 6th of May, 2024.

On a query of this court the learned advocate for the petitioner submits that he is not pressing any relief in respect of the complaint dated 8th August, 2023 which is annexed at page 54 of the writ petition. Such submission of the learned advocate is placed on record.

Mr. Sengupta, learned advocate for the State submits that the dispute between the parties arises out of a development agreement and the dispute is purely civil in nature. Such submission of Mr. Sengupta is placed on record.

Since the complaint has been lodged before the police authorities, it is the duty of the police authority to consider the same and act in accordance with law. In the event, the complaint discloses a cognizable offence, the police authorities are to take steps in accordance with law. If the respondent no.4 decides against the registration of FIR, the reasons therefor are to be communicated to the petitioner within a period of two weeks from the date of receipt of a server copy of this order.

With the above observation and direction the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties after completion of all necessary formalities.
