Under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016 the said order is an appealable one.

In view of the above, since there is an alternative, efficacious and speedy remedy left open to the petitioner under the statute, this writ petition W.P.A. 21108 of 2022 stands dismissed, without any order as to costs.

It is made clear that, this Court has not gone into the merits of the writ petit6ion at all and the petitioner shall be at liberty to urge whatever points they wish to urge before the appellate authority in accordance with law.

This order shall not create any right or equity in favour of the petitioner.
