Mr. Sandipan Pal ....for the petitioner. Mr. Tapas Ballav Mondal ...for the State. The petitioner claims to be an Orderly/Peon at the Kolkata Improvement Tribunal (in short "KIT"). The petitioner was superannuated at the age of 60 in January, 2010. After his superannuation he claims to have rendered services till November 2011. The same is not disputed by the respondent authorities.

The petitioner claims for disbursement of Rs.1,44,000/- for discharging services during the said period of extension. Despite representations made in 2011 and thereafter on July 4, 2022 and August 4, 2022 his arrears of pay have not been released by the respondent concerned. The petitioner submits that the respondent concerned are the respondent Nos. 1 and 3.

In the circumstances, the respondent no. 3 is directed to immediately consider the representations of the petitioner dated July 4, 2022 and August 4, 2022. The arrears of pay of the writ petitioner cannot be kept pending indefinitely. Upon giving personal hearing to the petitioner, the representations of the

petitioner are to be disposed of within four weeks from date and the reasoned order be communicated within one week thereafter, in the light of the fact that the extended period of service is not in dispute. The admissible dues, payable to the petitioner, should be disbursed within four weeks thereof. Since no affidavits have been called for in the instant writ petition all the allegations made therein are deemed not to have been admitted by the respondents.

With the aforesaid directions, the writ petition being WPA 21110 of 2022 is disposed of.

There will be no order as to costs.
