Petitioner is aggrieved by the fact that in spite of the direction passed in title suit no. 556 of 2022 by the learned Civil Judge, Junior Division, 2nd Court, Chinsurah, Hooghly and a direction upon the police authorities to ensure that the order dated 13.09.2022 is complied with, the petitioner is unable to raise construction of his boundary wall.

Having regard to the fact that the order was passed on 16.09.2022 and the police authorities have drawn up proceedings under section 107 of the Code of Criminal Procedure as is reflected from the report submitted by the learned advocate appearing on behalf of the State, I am of the view that the petitioner would file appropriate application before the civil court, on the other hand, police authorities

would also express the inconveniences faced for implementing the order passed by the civil court. If there has been any violation of the order passed by the civil court, appropriate steps be taken by the petitioner before the jurisdictional civil court concerned.

With the aforesaid observations WPA 20751 of 2023 is disposed of.
