Nalhati Vivekananda Vidyapith (H.S.) School & Ors. Mr. Tapan Datta Gupta, Mr. Parvej Anam ...for the Petitioners.

The petitioners are the defendants, who pray for expeditious disposal of Title Suit No.89 of 2015 which is pending before the learned Civil Judge (Junior Division), 2nd Court at Rampurhat, Birdbhum.

From the order sheet, it appears that the service was not ready when the application for expeditious disposal was filed. In my opinion, when service upon the defendant Nos.19 and 23 had not been effected, the question of filing an application for expeditious disposal of the suit did not arise. It is now submitted that some interlocutory applications have also been filed in the meantime.

This Court is not a position to ascertain the correctness of such submission. However, the learned trial Judge, who is in seisin of the matter and is acquainted with the facts and

circumstances, shall make sincere endeavour to expedite disposal of the applications and the suit.

This Court has neither gone into the merits of the applications nor into the merits of the suit. A copy of the revisional application along with a server copy of this order be served upon the opposite parties within a week.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
