I find from the records of the case that this is a case of matrimonial dispute and was registered under Section 498A of the IPC read with Sections 3 and 4 of the D.P. Act. Earlier submission was advanced before this Court that the parties have amicably settled such dispute and, as such, by an order dated 29.8.2023, the concerned officer-in-charge of the concerned P.S. was directed to record the statement and declaration from the private opposite party, namely, Nitika Agarwal. The statement and the declaration of Nitika

Agarwal has been enclosed along with the report. She has categorically stated that she has no intention to pursue with the present case and is presently staying with her husband and other relatives.

Having considered the changed circumstance, I am of the opinion that further continuation of Shibpur P.S. Case No. 298 of 2020 dated 19.10.2020 including the chargesheet therein, which is pending before the ld. JM, 1st Court, Howrah, is unwarranted and the same is hereby quashed. With the aforesaid observations, CRR 3231 of 2023 is allowed.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
