The D.I. is personally present in Court.

It appears that the School Service Commission is responsible for transferring the petitioner from North 24 Parganas to Malda has not been notified of this Court's order dated 28th July 2022.

The D.I., on his turn has launched himself to explore a replacement for the petitioner from local schools for the post of an Arabic teacher.

Apart from the aforesaid misunderstanding and non-communication of the order to the right authority, the Court also notices that the contempt is alleged of an order passed more than two years ago.

In terms of Section 20 under the provisions of the Contempt of Courts Act, 1971, an application for

contempt does not lie beyond a period of one year of passing of this order.

In view of the above, no order can be passed in the instant application. WPCRC 156 of 2024 is disposed of without any orders.

The personal appearance of D.I. is hereby dispensed with.

8.

Rule, if any, shall stand discharged.

9.

Liberty is, however, reserved to the petitioner to pursue the remedies in accordance with law.

10.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
