Case No.

of dated 16.07.2025, there has been no progress in the investigation; further, forged deeds have not been seized by the police authorities. Consequently in a case of such nature, there is no probability of police investigation to arrive at a perfect conclusion. State has submitted a report which reflects regarding the steps taken by the police authorities. Learned advocate for the State claims that police authorities have seized the deeds which are the subject-matter of the investigation.

Be that as it may, since the case was registered on 16.07.2025, after a period of 90 days is completed from the said date of registration of FIR, de facto complainant/petitioner is entitled to have a progress report.

Consequently, the

investigating officer of the case would send a progress report after the period of 90 days is over. In case the petitioner finds in the progress report that there are deficiencies in the investigation, petitioner would be at liberty to bring the same to the notice of the jurisdictional court in seisin of Raiganj P.S. Case No. 785 of 2025.

Learned Magistrate within the framework of law would pass necessary directions as he deems fit and proper.

With the aforesaid observations, the writ petition being WPA 20984 of 2025 is disposed of. A copy of the report be handed over to the learned advocate appearing for the petitioner. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
