1. Affidavit-of-service filed in Court today is taken on recored.

2. Complaining inaction on the part of the municipal authorities to disburse the balance amount of gratuity that has fallen due to the petitioner, the instant writ petition has been filed. It appears that though a Pension Payment Order (PPO) was issued, the petitioner is yet to receive the gratuity amount.

3. According to the petitioner, the PPO dated 24th December, 2024 was issued consequent upon the retirement on 30th September, 2024. The municipality has, however, not disbursed the entire amount of gratuity. It has submitted that the petitioner was an employee of the Contai Municipality. He was entitled to

the admitted amount of gratuity determined in the PPO, the same is yet to be disbursed in its entirety.

The learned advocate representing the municipality has placed before this Court a Whatsapp communication received from the municipality and would submit that in the instant case, the petitioner has already been disbursed a sum of Rs.1,50,000/- out of the gratuity amount determined in the PPO, and thereby leaving an outstanding sum of Rs.5,59,308/-. Let a copy of the written communication as received by the learned advocate representing the municipality as placed before this Court be taken on record.

Having heard the learned advocate for the respective parties and considering the materials on record, I find that the petitioner in terms of the PPO, was entitled to gratuity to the extent of Rs.709308/-. Out of the aforesaid sum, the petitioner has received Rs.1,50,000/- that to in three instalments, i.e., on 15th January, 2025, on 13th June, 2025 and on 29th August, 2025. The balance amount of Rs.5,59,308/- on account of gratuity is outstanding.

Having regard to such admitted position, I direct the municipality to forthwith make payment of the entire outstanding amount of gratuity along with interest @ 10% per annum from the date when the same became payable that is immediately on the retirement of the petitioner till the actual disbursal thereof.

7. The aforesaid payment should be made within a period of six weeks from the date of communication of this order.

8. With the aforesaid directions and observations, the instant writ petition stands disposed of.
