Mr. Ray, learned advocate appearing for the petitioners in OA 49 of 2009, who have preferred the present writ petition, submits that the order impugned in the present writ petition was also challenged by petitioners in other original applications which were heard analogously and finally decided by an order dated 22nd March, 2013. Aggrieved by the said order, the applicants in other original applications preferred a writ petition being WPCT 214 of 2013 which was disposed of by an order dated 13th December, 2013 setting aside the order of the learned Tribunal dated 22nd March, 2013.

Mr Drolia, learned advocate appearing for the respondents does not dispute such contention of Mr. Ray and submits, upon instruction, that the petitioners in the present writ petition were granted an opportunity of personal hearing and allowed to cross

examine the experts of CFSL. However, no further action was taken due to pendency of the present writ petition. Let the order dated 13th December, 2013 passed in WPCT 214 of 2013 and the written instruction, as produced, be kept on record.

We have heard the learned advocates appearing for the respective parties and considered the materials on record.

The petitioners in the said writ petition being WPCT 214 of 2013 are similarly situated with the petitioners herein and we do not find any reason to differ with the order passed by the coordinate Bench of this Court in the writ petition being WPCT 214 of 2013.

Accordingly, the writ petition is disposed of directing that the respondents shall take all necessary follow up steps, as taken in respect of the petitioners in WPCT 214 of 2013, in terms of the direction of the coordinate Bench in the said writ petition.

With the above observations and directions, the writ petition being WPCT 285 of 2013, is disposed of. There shall, however, be no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied as expeditiously as possible. (Partha Sarathi Chatterjee, J.) (Tapabrata Chakraborty, J.)
