The writ petitioner applied for the post of constable (GD) in Central Armed Police Forces for the year 2022. In course of medical examination he was found over weight. The same has been confirmed by the review medical board.

Counsel for the petitioner would argue that the petitioner is now within the acceptable limits of weight.

It is now well settled that the medical condition of the petitioner at the time of the assessment is what is required to be taken into consideration. Any subsequent changes made at the instance of the petitioner cannot be accepted. 4.

No relief can, therefore, be granted to the petitioner.

However, the petitioner shall not be prevented from participating in any other selection process for the same post that may be conducted in future. 6.

The writ petition is disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
