The writ petitioner challenges inaction on the part of the respondent/F. C. I. in acting in terms of the decision of the Appellate Authority under the Payment of Gratuity Act, 1972 which has upheld the order of the Controlling Authority dated 30th May, 2022 passed in Application No.PG/2/07/2022/ALCR.

The Appellate Authority, however, directed the F.C.I. to comply with the order of the First Authority and re-look into the claims of the workman morefully described in the representation dated 15th July, 2022. 3.

Let a decision be taken by the F. C. I. based on the order of the First Authority dated 30th May, 2022 and the Appellate Authority dated 30.03.2023 within a period of 45 days from the date of receipt of a copy of this order and pass a suitable order.

With the aforesaid observations, the writ petition is disposed of.

There will be no order as to costs.
