The alleged contemnor no. 1 is personally present before us with the child. The child is handed over to the petitioner/father. The child is to be admitted in Gobardanga Nivedita Primary School. However, the said admission could not be ensured as the name of the father entered in the school record of Baikola Chayanir Primary School, where the child is presently studying, is the name of paramour of the alleged contemnor no. 1. We direct the institutional head of the Baikola Chayanir Primary School to correct the name of the father of the child in the school record by deleting the name already recorded and inserting the name of the petitioner, namely, Sri Samir Pal, and immediately after such correction is carried out to hand over the transfer certificate to the petitioner in order to enable him to admit her daughter to Gobardanga Nivedita Primary School. The learned advocate appearing on behalf of the alleged contemnor no. 1 submits that mercy may be shown to the alleged

contemnor no. 1 in view of the relationship between the alleged contemnor no. 1 and her daughter. The alleged contemnor no. 1 tenders her unconditional apology.

In view of the unconditional apology tendered by the alleged contemnor no. 1 and assurance given that there shall be no future violation, we accept the apology tendered by the alleged contemnor no. 1 and drop the contempt proceeding. The contempt rule stands discharged accordingly. There will be no order as to costs.
