Report of the Excise Commissioner, West Bengal signed on 27.01.2025 is placed on record. 2.

It appears there from that the Legal Remembrancer has opined that the late fine under Rule 14(5) of the West Bengal Excise (Selection of New Site and grant of license for retail sale of liquor and other intoxicants) Rules, 2003 should be calculated at the rate of Rs. 100/- per day from the date following the date of expiry of the license and not in a cumulative way.

The instant writ petition stands disposed of by directing the Excise Commissioner to make the necessary calculation as per the opinion of the learned Legal Remembrancer submitted in Court today.

Steps shall be taken in the matter at the earliest.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
