Mr. Lakshmi Nath Bhattacharyya ...for the petitioner The petitioner has approached this court by way of the instant revisional application assailing an order dated August 9, 2023 passed by the learned Judicial Magistrate, 5th Court, Paschim Medinipur in Misc. Execution Case No.24 of 2023.

I find that a sum of Rs.40,000/- was the subject-matter of case for which it was preferred. The petitioner claims that he has already paid the sum of Rs.9,000/- so far.

The petitioner is, therefore, directed to pay a sum of Rs.10,000/- in the court of learned Judicial Magistrate, Paschim Medinipur by September 10, 2023. On such payment being made, learned court would stay the execution of warrant of arrest till October 11, 2023. The petitioner would pay a further of sum of 10,000/- on or before October 10, 2023. The warrant of arrest thereafter would be kept in abeyance till November 24, 2023. The remaining dues of Rs.11,000/- would be paid by the petitioner by November 22, 2023 resulting in recalling of the warrant of arrest issued against him. For the time being, the learned Magistrate would keep the warrant of arrest of the petitioner in abeyance till September 10, 2023. No leniency would be granted to him for changing or altering the schedule fixed by this court.

With the observations as above, CRR No.3241 of 2023 stands disposed of.
