The learned Counsel for the petitioner submits that the petitioner the married sister-in-law of the victim. It is submitted that the petitioner is no way involved in the commission of the alleged offence. 2.

The learned Counsel for the State has produced the case diary and the statement of the witness related to the deceased and the postmortem report. It is further submitted that the investigation is complete and charge sheet has been filed.

Considering the materials available in the case diary, the nature and extent of involvement of the petitioner and in view of the fact that no specific overt act is attributed to the petitioner, we are of the view that custodial interrogation of the present petitioner is not necessary.

Accordingly, we direct that in the event of arrest the petitioner namely, Rina @ Rani Sardar @ Mondal, shall be released on bail upon furnishing a bond

of Rs.10,000/-, with two registered sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Basirhat, North 24 Parganas, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, subject to further condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders.

5. In the event the petitioner fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without any further reference to this Court. 6.

Accordingly, the prayer for anticipatory bail of the petitioner is allowed.
