1. Petitioner contends he was falsely implicated in the instant case in order to blackmail him.

2. I have considered the materials on record. Uncontroverted allegations in the FIR show petitioner had outraged the modesty of the victim girl in an auto-rickshaw. Petitioner contends the allegations are patently absurd. It is not unknown co-passengers misbehave and outrage modesty of other fellow women passengers.

3. Hence, I am of the opinion uncontroverted allegations in the FIR which discloses a sexual crime does not call for interference. It is open to the petitioner to canvass his defence including the plea of mala fides at the appropriate stage of the proceeding in accordance with law.

4. With the aforesaid observations, CRR 3623 of 2024 is disposed of.

5. Photostat certified copy of this order, if applied for, be given to the petitioner on usual undertaking.
