The petitioner apprehends that the Panchayat will give water connection to the private respondent Ram Pravesh Gupta by laying the pipeline just by the side of the outer wall of the petitioner.

According to the petitioner, the common passage is 4 feet 4 inches wide. The petitioner does not have any objection if at least 1 foot gap is maintained in between the pipeline and the outer wall of the petitioner.

In the earlier writ petition filed by the private respondent being WPA 26453 of 2022, the Court passed order on 14th December, 2022 directing installation of water connection through the common passage.

The Panchayat is directed to install water connection and lay pipeline through the common

passage by keeping at least 1 foot gap between the pipeline and the outer wall of the petitioner. The writ petition stands disposed of.
