Parvin ... for the Petitioner(s) Mr. Argha Chowdhury ... for the State-Respondent(s) Mr. Abhijit Chowdhury Mr. Subham Agarwal ... for the Respondent No. 4 Learned advocate for the petitioner submits that the petitioner - who is physically handicapped, is suffering from mental depression at the behest of the private respondents who are trying to grab her property. There were several instances for which information were furnished with the police authorities.

The records of the writ petition reflects that in the year 2021, a complaint was made for which a case was registered under Section 380 of the IPC.

Subsequently, charge-sheet was submitted

in the year 2023.

The report submitted by the State reflects that there are several civil suits in respect of the land and building. The boundary wall was found to have been damaged. However, the same was due to movements of certain vehicle transportation.

There are statement of facts which have been narrated by another co-sharer namely, Sipra De.

The petitioner preferred an application under Section 163(2) of the BNSS. The police report prima facie reflects that there is a dispute amongst the co-sharers.

Presently, no specific complaint has been laid with the police station.

Learned advocate for the private respondents disputes and denies the accusations and submits that a civil suit has been given the colour of a criminal proceeding.

I have considered the submissions of the learned advocate appearing for each of the parties and, on an assessment of the facts so narrated, I am of the view that so far as the police authorities are concerned, they already have kept a strict vigil, they would continue their surveillance as also ensure that there is no violation in respect of any law and order.

However, if the petitioner is faced with any inconveniences, she would submit a fresh representation before the police authorities and the police authorities would consider the same in accordance with law.

So far as the other issues are concerned, the petitioner and the private respondents would be at liberty to ventilate their grievances before the appropriate forum.

With the aforesaid observations, WPA 20999 of 2025 is disposed of.
