The grievance of the petitioner is directed against a claim for compassionate appointment. Pursuant to the filing of the writ petition, the State has filed a Report in the form of an Affidavit, which suggest that the State had conducted a comprehensive enquiry and also submitted an enquiry report as to why the petitioner is not entitled to compassionate appointment.

Significantly, there is no challenge to the said Enquiry Report or any of the steps taken by the State in the writ petition.

These facts have not been dealt with in the proceedings.

In view of the stand taken by the State and the contents of the Enquiry Report, WPA 20794 of 2023 stands disposed of by granting liberty to

the writ petitioner to file a writ petition afresh challenging the Enquiry Report and all consequential steps taken by the State in accordance with law, if so advised.

With the above directions, WPA 20794 of 2023 stands disposed of.
