Petitioner is aggrieved by the fact that in spite of informing the police authorities regarding the act and action of the private respondents, no action has been taken.

On the other hand, learned advocate appearing for the respondent nos.7 and 8 submits that a sum of Rs.3,00,000/- have already been paid as committed by the private respondents.

State submits that in view of the nature of the transactions, police authorities did not register any case.

Having considered that the information so furnished was on 22.07.2024 with the Officer-inCharge, Gurguri Pal Police Station not being acted upon, petitioner would be at liberty take out an

appropriate application under Sections 175 (3) of the BNSS before the jurisdictional court concerned. Learned Magistrate would assess as to whether any cognizable offence has been made out and also ascertain as to whether any case for investigation is made out and thereafter pass necessary directions by exercising his discretion.

With the aforesaid observations, WPA 21434 of 2024 is disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
