A representation made on behalf of the petitioner seeking withdrawal of the decision of the Suri Municipality to stop the work relating to restoration of the Birbhum District Sports Association is pending consideration before the Suri Municipality.

Learned advocate appearing on behalf of the State respondents submits, upon instructions that, the District Sports Association permitted the petitioner to make the necessary restoration work without obtaining any sanction from the Municipality.

Learned advocate appearing on behalf of the Municipality submits, upon instructions that, sanction which was given for restoration has been revoked by the Board of Councilors of the Municipality. As on date there is no sanction for proceeding with the restoration work.

Without entering into the merits of the claim and counterclaim of the parties at this stage, as it appears that the representation of the petitioner is pending consideration before the Municipality, accordingly, the instant writ petition is disposed of by directing the Municipality to consider and dispose of the legal representation filed on behalf of the petitioner in March 2024 by passing a reasoned order, at the earliest but positively within a period of eight weeks from the date of communication of this order. 5.

The Municipality shall provide an opportunity of hearing to the petitioner prior to passing a final order in the matter.

Learned advocate appearing on behalf of the petitioner is directed to forward a copy of the legal representation dated 18th March, 2024 along with all supporting documents to the aforesaid respondent at the time of communicating the order of the Court. 7.

The writ petition stands disposed of.

Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
