09.09.2025 Sl. No. 37 AMR Ct.No.15 WPA 21004 of 2025 Smt. Jyotsna Panja -vs.- The Calcutta Electricity Supply Corporation Ltd. & Ors.
Mr. Achin Jana Mr. Suman Chakraborty Mr. Prosenjit Ghosh Mr. Bhaskar Dalui Ms. Jaysri Dhar Mr. Chetna Rustagio ...for the petitioner Mr. Debanjan Mukherjee ...for the CESC It is an admitted position that, due to unauthorized use of electricity, a final order of assessment directing the petitioner to deposit a sum of ₹828/- was issued on 1st September 2025.
Consequently, the petitioner's electricity connection was disconnected.
The learned counsel for the petitioner further submits that the petitioner is willing to remit the aforementioned amount within 72 hours from the date of this order.
On the other hand, learned counsel for CESC submits that an outstanding amount of ₹10,12,235/- remains unsettled in relation to a connection held by the petitioner's son for the same premises.
I am of the view that nothing prevents CESC from proceeding against the son of the petitioner for the alleged unauthorised use of electricity. The line of the petitioner should be restored upon acceptance of the payment.
In view of the foregoing, this writ petition is disposed of, granting liberty to the petitioner to deposit the sum of ₹828/- along with the applicable connection charges within 72 hours from the date hereof. Upon receipt of the said payment, CESC shall forthwith restore the petitioner's electricity connection. Accordingly, WPA 21004 of 2025 stands disposed of.
Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
