1. The affidavit-of-service as filed today on behalf of the writ petitioner is taken on record.

2. The writ petitioner and the respondents/State are represented by their respective Counsels.

3. On perusal of the petition under consideration and after hearing the learned Advocates for the contending parties it appears to this Court that it is the case of the writ petitioner that he is the owner of 2 satak of land in Hal plot no. 1202 in Mouza - Dhannyogari under P.S. - Joypur. It further reveals that it is the grievance of the writ petitioner that the respondents/authorities have utilized a portion of his said land for the purpose of construction of a bridge without initiating any process of acquisition and without disbursing any compensation. It reveals that the writ petitioner has submitted a representation with the respondent no. 2/authority on 18.04.2024 but the same is still unheard.

4. Learned Advocate for the respondents/State in his usual fairness submits before this Court that the

respondent no. 2/authority may be directed to consider the representation dated 18.04.2024 in accordance with law.

5. In view of such, this Court while disposing the instant writ petition directs the respondent no. 2/authority to consider the representation dated 18.04.2024 as filed by the writ petitioner in accordance with law and after giving an opportunity of hearing either to the writ petitioner and/or his legal representative shall pass a reasoned order and shall forthwith communicate the same to the writ petitioner preferably by mail, if the mail details of the writ petitioner is furnished to him at the time of hearing.

6. The entire exercise as indicated hereinabove is to be completed by the respondent no. 2/authority positively within working days from the date of communication of the server copy of this order.

7. Liberty is given to the learned Advocate-on-Record for the writ petitioner to forward a server copy of this order along with a copy of the representation dated 18.04.2024 to the respondent no. 2/authority.

8. The respondent no. 2/authority is directed to act on the server copy of this order.

9. Before parting with, it is made clear that since affidavits have not been called for, the allegations made in the writ petition are deemed to have been denied.

10. It is further made clear that before the respondent no. 2/authority all points including points of limitation are kept open.

11. With the aforementioned observation, the instant writ petition being WPA 21444 of 2024 is disposed of.

12. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
