The writ petitioner challenges the rejection of bid of M/s Yukti Vridhi Private Limited herein the writ petitioner by the West Bengal Mineral Development and Trading Corporation Limited (WBMDTCL) herein respondent No.2.

The facts of the case are that the petitioner submitted bid for tender no.

MDTC/SAND/ 002/1306 floated for preparation of Mining Plan and Environment Clearance of sand blocks by paying application fees and uploading relevant documents in the portal.

The Technical Bid Opening report dated 23.06.2023 published by respondent authorities did not feature the name of the petitioner company due to technical issues. A representation vide letter dated 27.06.2003 was made by the petitioner requesting a chance for participation in the tender process.

The learned counsel for the petitioner submits that inspite of participating in the tender process,

WPA 20807 of 2023 -2inadvertent latches resulted in the failure of the petitioner to annex one relevant document.

The learned counsel for the respondent authorities affirm that if necessary correction is made by the petitioner, his application may be evaluated again.

Having heard the learned counsel for the parties and on perusal of records, this Court directs that if the petitioner files necessary corrected application within a week, such application must be considered by the respondent authorities and evaluated along with other bidders in accordance with law.

With the above observation, writ petition being WPA 20807 of 2023 is disposed of.
