1. The writ petitioners and the respondents/State are represented by their respective Counsels.

2. The affidavit-of-service as filed today on behalf of the writ petitioners is taken on record.

3. The instant writ petition has been filed by the writ petitioners being aggrieved for not disbursing compensation for acquisition of land their by the respondent no. 3/authority.

4. At the time of hearing, Ms. Charaborty, learned Advocate duly led by Mr. Partha Pratim Roy, learned Advocate for the writ petitioners draws attention of this Court to page no. 21 of the instant writ petition being a copy of the representation dated 21.09.2010 as submitted by the writ petitioners with the respondent no. 4/authority ventilating their grievance. It is submitted by Ms. Chakraborty that despite submission of representation the respondent no. 3/authority sat tight over the matter and practically did nothing. It is thus submitted by Ms. Chakraborty that appropriate

relief/reliefs may be granted to the writ petitioners in terms of the prayers made in the instant writ petition.

5. Mr.

De, learned AGP appearing for the respondents/State in his usual fairness submits before this Court that the respondent no. 3/authority may be directed to consider the representation of the writ petitioners in accordance with law.

6. In view of such, this Court while disposing the instant writ petition directs the respondent no. 3/authority to consider the representation of the writ petitioners dated 21.09.2010 as has been annexed at page no. 21 of the instant writ petition in accordance with law and after giving due opportunity of hearing to the writ petitioners and/or their legal representatives and/or any other stake holders if he deems fit and proper shall pass a reasoned order and shall forthwith communicate the same to the writ petitioners within 60 working days from the date of communication of the server copy of this order.

7. Liberty is given to the learned Advocate-on-Record to communicate the server copy of this order together with a copy of the representation dated 21.09.2010 to the respondent no. 3/authority and the respondent no. 3/authority is directed to act on the server copy of this order.

8. With the aforementioned observation, the instant writ petition being WPA 20824 of 2023 is disposed of.

9. Urgent Xerox certified copy of this order, if applied for, be given to the parties upon compliance of all necessary formalities.
