The affidavit-of-service as filed in Court today is taken on record.

On perusal of the petition under consideration and after hearing the learned advocates for the contending parties, it appears to this Court that present writ petitioner has sufficiently explained the reason as to what prevented him to appear before this Court on 03.07.2025 when WPA 20825 of 2023 was taken up for hearing.

Accordingly, prayer is allowed.

The order dated 03.07.2025 as passed in WPA 20825 of 2023 is hereby recalled subject to payment of cost of Rs. 2,000/- which is to be deposited with the Law Clerks' Welfare Trust Board within seven working days from today.

In view of such order, WPA 20825 of 2023 is restored to its original file and number.

It is made clear that in the event, the cost is not deposited within the stipulated period, the instant order will be recalled.

With the aforementioned observation, CAN 1 of 2025 is disposed of.

Learned advocate for the respondent nos. 2 to 5 files affidavit-in-opposition which is taken on record. 2.

Mr. Ray, learned advocate appearing on behalf of the writ petitioner submits before this Court that he will file the affidavit-in-reply on the adjourned date. He further submits that a copy of such reply has ready been served upon the learned advocate for the respondent nos. 2 to 5. 3.

Such being the position, let the matter be listed under the heading "Adjourned Motion" on September 12, 2025. 4.

Mr. Ray, learned advocate for the writ petitioner is hereby requested to intimate the next date of hearing by issuing a notice in writing along with a server copy of this order to the office of the Ministry of Law and Justice, Department of Legal Affairs, Branch Secretariat, 11 Strand Road, Kolkata - 700 001 and to file the receipted copy of such notice and the money receipt showing deposit of cost on the adjourned date.
