Rakib (rejected) CRM (M) 1569 of 2025 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Salanpur Police Station Case No. 55 of 2025 dated 08.04.2025 under Sections 140(2)/61(2) of the Bhartiya Nyaya Sanhita, 2023 and adding Sections 118(1)/118(2)/3(5) of the Bhartiya Nyaya Sanhita, 2023.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 224 days, the investigation of the case has already been concluded, charge-sheet has been submitted and charge has already been framed. Additionally it has been submitted that within one and half hours the victim was recovered and there was no monetary transaction which took place prior to which the petitioner along with others were intercepted by the police authorities.

Learned advocate for the State on the other hand submits that after the stage of consideration of charges were over and 8 witnesses out of the proposed 19 witnesses have already been examined and the prosecution evidence is at the vital stage.

Having considered the submissions of petitioner as well as that of the State, as well as the materials appearing in the Case Diary, I am not inclined to release the petitioner on bail. Accordingly, CRM (M) 1569 of 2025 is dismissed. However, I direct the learned trial Court to complete the prosecution witnesses within a period of four months from date preferably by 15th of March, 2026.

Petitioner would be at liberty to renew the prayer for bail after the said period is over.

Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
