Mr. Bhaskar Prasad Vaisya Mr. Suman Dey ...for the State The matter was considered by this Court on 21st September, 2022 and Court was about to dismiss the writ petition on the ground of default since no one was representing the petitioner. However, on perusal of records on 21st September, 2022 this Court found that in spite of depositing Government share along with interest on behalf of the husband of the petitioner who is a retired assistant teacher the Assistant Director, Pension, Provident Fund and Group Insurance by issuing memo dated 29th November, 2016 refused to settle the pension case in favour of the petitioner being the widow of the deceased teacher.

Considering the issue involved in this writ petition this Court requested Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader who was present in Court to take instruction why the family pension was not paid to the petitioner in spite of depositing requisite sums with the State Government as per norms as it emanates

from memo dated 29th November, 2016 issued by the Assistant Director, Pension, Provident Fund and Group Insurance.

Accordingly, the matter is listed today for further consideration when Mr. Vaisya has submitted, on instruction, that family pension has already been released in favour of the petitioner and the petitioner is in receipt of family pension regularly pursuant to the Pension Payment Order issued by the State-respondents. In support of such submission the statement generated in the office of the Barrackpore-II Treasury as well as the copy of the Pension Payment Order (not legible) are placed before this Court which are taken on record. In view of release of family pension in favour of the petitioner it appears nothing requires to be decided in this writ petition and accordingly the writ petition stands disposed of.
