WPA 20919 of 2025 (Badal Shit vs. State of West Bengal & Ors.) For the Petitioner Mr. Suman Dey Mr. Chittaranjan Ghosh .... For the State The prayer of the petitioner is twofold:

First, fair and unbiased investigation with regard to the complaint lodged by him. Second, allowing him to raise construction in his land by providing police protection. It appears that charge sheet has been submitted upon completion of investigation on 30th August, 2024. In the event the petitioner is aggrieved by the mode and manner of investigation he is at liberty to approach the appropriate Magistrate for redressal of his grievance. The petitioner seeks to raise construction in his land and alleges that he is being obstructed by the private respondents who are also threatening and assaulting him each day. In that event also the petitioner shall approach the appropriate Court for redressal.

However, the police authority is directed to keep strict vigil in the area in view of the strained relationship between the parties and shall ensure that no untoward incident occurs and there is no breach of peace and tranquility. The writ petition is accordingly disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
